Definition of Copyright Infringement

Policy on Unauthorized Content

Reporting Copyright Infringement

  1. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material.
  3. Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address.
  4. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.

Upon receipt of a valid notification, we will promptly investigate the claim and take appropriate action, which may include removing or disabling access to the allegedly infringing material.

Counter-Notification

If you believe that the material you posted was removed or access disabled by mistake or misidentification, you may submit a counter-notification to our Copyright Agent. To be effective, the counter-notification must include:

  1. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  2. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  3. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your jurisdiction, and that you will accept service of process from the person who provided the original notification or an agent of such person.
  4. A physical or electronic signature of the subscriber.

Upon receipt of a valid counter-notification, we will forward it to the original complainant. The removed material may be replaced or access restored in 10 business days, unless the original complainant files a court action seeking to restrain the alleged infringer from engaging in infringing activity.

Repeat Infringers

In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws, HyundaiMechanic.com will terminate, in appropriate circumstances, users who are deemed to be repeat infringers. We also reserve the right to terminate user accounts based on a single infringement.

Modifications to Policy

We reserve the right to modify this policy at any time. Changes will be effective immediately upon posting to our website. Your continued use of the site following the posting of changes constitutes your acceptance of those changes.
